Judge Denies Cincinnati's Motion To Dismiss Plush Lawsuit

(Cincinnati) - The case the family of Kyle Plush filed against the city of Cincinnati will move forward after all.

Hamilton County Judge Robert Ruehlman denied Cincinnati's motion to dismiss the wrongful death suit filed against the city, emergency dispatchers and police officers who responded to Seven Hills School in 2018.

Sixteen-year-old Kyle was in the parking lot of the school and became trapped in the backseat of his van while trying to retrieve his tennis racket. He called 911 multiple times, but police officers couldn't find him. He suffocated to death.

Ruehlman ruled there's enough evidence for a wrongful death lawsuit to move forward.
