Kenton County Prosecutor: No Charges in Deadly Home Invasion

( Covington, Kentucky ) - A 24-year-old man whom investigators say fatally shot a man who broke into a house early Tuesday morning will not face criminal charges.

In a statement released late Tuesday afternoon, Kenton County Commonwealth Attorney Rob Sanders (pictured above) announced details of the incident on West 7th Street. He says 43-year-old Joshua Kersey of Cincinnati was one of three men who broke into a home near Greer St just after 1:30am. The three were allegedly armed and wearing all black with ski masks. Investigators say they threatened the homeowners while demanding information about a person "who has not lived in the residence for a number of years." At one point, a person in the home retrieved his handgun and shot Kersey. All three suspects ran and Kersey collapsed nearby outside where he was found by first responders and eventually pronounced dead at the hospital.

The other two suspects are at large, and because of their disguises, are only described as being six-foot-tall men. 

Sanders says the man who fired the deadly shot "was entitled to use deadly force in defense" of the home. Covington Police Chief Rob Nader says neighbors should know this was not a random attack, and that their neighborhood is still safe.
