Former Hamilton County Deputy Indicted for Abuse

The Prosecutor in Hamilton County would not take to the case to the grand jury but federal prosecutors did and now a former HCSO Corrections Officer is facing 10 years in prison for use of excessive force. Jason Mize is charged with using unreasonable force while acting under color of law in an indictment unsealed from a federal grand jury.

The charges are related to booking a Silverton man into the Hamilton County Justice Center last year. The indictment alleges that Mize shoved the prisoner against a concrete wall breaking his leg and causing head injuries. Mize resigned from the sheriffs department before he could be disciplined over the incident but the Channel 9 I-Team discovered that it was the 4th time that Mize had been accused of using excessive force inside the jail.

The victim, 62 year old Mark Myers sued the county over his injuries and the case was later settled out of court for a half million dollars. Mize has been arrested by the FBI and is now awaiting arraignment in U-S District Court.
