Tensing Retrial: Deliberation Begins

( Hamilton County ) - For the second time, a jury of 12 men and women is weighing the evidence, and considering charges against former UC Police Officer Ray Tensing.

Both sides delivered closing arguments on Monday morning. Assistant Prosecutor Stacey DeGraffenreid referred to the case as a "puzzle" that the jury had to put together. "The defendant, Mr Tensing's actions played a significant role in creating this dangerous situation," she said during her closing arguments. She also encouraged the jury to use common sense, "use your own common sense which you use in your everyday life. Work together as a group. Look at all the evidence to put the puzzle together."

After DeGraffenreid spoke, it was defense attorney Stew Mathews' turn. He repeated his client's defense that he felt he was dragged, and that's why he fired the shot that killed Sam DuBose. "Ray said he was dragged... dragging has to start somewhere," Mathews said. He also told the jury that Tensing was doing what the department told him to do by increasing patrols around the UC campus. 

Then, the prosecution got the final word with Seth Tieger delivering the closing rebuttal. Tieger talked about the importance of the Tensing body cam video, comparing it to a recent Reds baseball game where an important call was over-turned based on replay video. "That video has no bias, that video has no feelings." Tieger says the video disproves Tensing's version of the story.

Judge Leslie Ghiz then gave the jury their instructions, and the deliberation process is now underway.
