UPDATE: Judge Leslie Ghiz ruled Thursday morning that the retrial of Ray Tensing will proceed, turning down a motion to dismiss from Tensing's attorneys.

The motion stemmed from an interview that Hamilton County Prosecutor Joe Deters gave to WCPO Channel 9, and the judge warned both sides that if anyone talks to the media again, they'll be held in contempt of court.

Hundreds of potential jurors reported to the Hamilton County Courthouse Thursday morning to fill out questionnaires.

( Cincinnati, OH ) AP — Attorneys for a former University of Cincinnati Police officer, who fatally shot an unarmed black motorist, are asking a the judge to dismiss the case on the eve of his murder retrial. 

The defense for Ray Tensing claims the Hamilton County Prosecutor violated a gag order.

The defense filed their motion Wednesday less than two hours after WCPO posted a story in which Prosecutor Joe Deters is quoted about the case, suggesting that Judge Leslie Ghiz could add lesser charges to the original charges of murder and voluntary manslaughter.

The previous jury couldn't reach a verdict. Prospective retrial jurors are scheduled to report Thursday.

The former UC officer testified he feared for his life when Samuel DuBose tried to drive away during a 2015 traffic stop.
