Second Mistrial in 4-Year-Old's Death

( Warren County ) - Another mistrial has been declared for the man accused of not seeking medical attention for his son before the boy's death.

Day 2 of the retrial of Robert Ritchie of Franklin was Tuesday. He's charged with involuntary manslaughter and child endangering in the death of his 4-year-old son last year in Franklin. Prosecutors say he waited 15 hours before seeking medical attention after his wife told him she put the boy in hot water. When Ritchie checked on the child the next morning, the boy was dead.

During testimony Tuesday morning, Ritchie vomited in court after an autopsy picture of little Austin Cooper was shown. Prosecutors asked for a mistrial and the judge agreed.

Ritchie's wife, Anna, is already serving a life sentence for the boy's murder. Ritchie's first trial ended with a hung jury. 

A new trial date is set for August 21.
