( Evanston ) - A lawsuit filed by former Xavier basketball player Dez Wells is seeking compensatory, punitive, and special damages from the university after he was expelled in 2012.

Wells was accused of rape, and even though a Hamilton County grand jury decided not to indict him, the school kicked him out for a "serious violation" of the code of conduct. 

Wells has since transferred to the University of Maryland, but he says he's still heckled by fans and he wants Xavier to vacate his expulsion, even though he has no intention of returning.
